Comprehensive Estate Planning by the People Who Wrote the Book

Who better to prepare your traditional estate planning documents than the firm that is nationally known for its work on behalf of those who want to retire with dignity and independence? Firm Founder, Rory Clark, Esq., literally wrote the book, The Family Estate Planning and Elder Law Guide (2019). Not every client needs sophisticated long-term care or tax planning, but this does not mean that all estate planning lawyers are the same. Our planning professionals have the legal and personal experience to handle your more traditional estate planning matters and deliver a “cut-above” product. Our “Fundamentals” and “Family” planning levels, in particular, are created from an elder law perspective because we know that sometimes the unexpected happens and having the right kind of tools available can make all the difference in an emergency. All of our estate planning packages are provided on a fixed-price and economical basis.

The BASICS Plan

The BASICS planning level is designed for those who are budget conscious but know they need to have something in place in case of an emergency.  With the Legacy Elder Law Center’s BASICS plan,  you can appoint guardians for minor children and specify who you want to handle your affairs in the event of your death.  The BASICS includes more than planning for your death.  It includes basic emergency life planning as well.  Be confident that emergencies will be handled by those you trust by naming agents to make healthcare decisions in the event you are not able to handle your medical affairs and manage your financial matters.  The BASICS may be perfect for the new homeowner or the young family.  We offer separate pricing for single and married clients.

Our BASICS Plan Includes:

  • Advance Medical Directive and Durable Healthcare Power of Attorney with HIPPA Authorizations
  • Simple Durable General Financial Power of Attorney
  • Last Will and Testament

The FUNDAMENTALS Plan

The FUNDAMENTALS planning level is designed for those who want to avoid probate and make it is as easy as possible for those they choose to easily and conveniently handle their affairs in the event of a disability.  At this planning level, Legacy Elder Law Center clients can rest assured that no court intervention will be necessary to appoint a guardian or conservator for them.  Their most-trusted family members or friends will be able to directly and immediately help with financial and medical decisions, if required.  The FUNDAMENTALS plan takes care of guardians and trusts for minors and makes the cumbersome and expensive probate process unnecessary.

Our FUNDAMENTALS Plan Includes:

  • Enhanced Advance Medical Directive and Durable Healthcare Power of Attorney with HIPPA Authorizations
  • Enhanced Durable General Financial Power of Attorney
  • Probate-Avoiding Revocable Living Trust
  • Last Will and Testament
  • Retitling Assistance
  • All Necessary Virginia, Maryland, and D.C. Deeds
  • One-Year Membership in Our Concierge Care Plan

The FAMILY Plan

For the serious traditional planners, our FAMILY Plan not only provides a comprehensive estate plan with guardianship and probate avoidance, this plan creates a legacy of responsibility and protection not just for the current generation but for your descendants as well. Our FAMILY Plan allows you to safeguard your heirs’ inheritances from divorce, creditors, and addiction as well as confidently plan for those who may have special needs.

Our FAMILY Plan Includes:

  • Enhanced Advance Medical Directive and Durable Healthcare Power of Attorney with HIPPA Authorizations
  • Enhanced Durable General Financial Power of Attorney
  • An Enhanced, Probate-Avoiding Revocable Living Trust designed to protect the assets you leave to your beneficiaries from the divorce court, their creditors, and from possible addiction. This trust also contains provisions to protect inheritances that would go to beneficiaries with Special Needs so as not to interfere with their own valuable income and healthcare benefits.
  • Last Will and Testament
  • Retitling Assistance
  • All Necessary Virginia, Maryland, and D.C. Deeds
  • One-Year Membership in Our Concierge Care Plan

Emergency Guardianship Planning

Clients may add our Emergency Guardianship Plan to any level of service for a fixed price of $500.  The Emergency Guardianship Plan is designed to instantaneously protect your children from custody by child protective services and/or the foster care system in the event of an emergency or sudden death.  Our proprietary temporary and emergency designation is drafted to comply with statutory requirements.  It becomes immediately effective and covers your children until the court can appoint a suitable temporary or permanent guardian.

Emergency Guardianship Planning Includes:

  • Our Proprietary, Multi-State Temporary and Emergency Guardianship Designation

I’m not going to get into details here. I’ll just leave you with one thing. Would I ever go back and use this firm for other family matters? No, I would not. I didn’t have the confidence in them. That said, trust your gut.

I phoned Legacy Elder Law Centre from Canada regarding probate of an estate in Virginia. Spoke to the receptionist with a brief description of the services I needed to deal with. She was very nice and very helpful. She knew exactly who I needed to speak to regarding this matter and informed me she would give my message to Emily, who would call me back shortly.
Emily did in fact call me back shortly and listened to my questions and concerns and answered all my questions. By the end of the phone conversation I felt very comfortable with Emily and that she was the right person to help me. She listens...and she answers. She is very knowledgeable and she is amazing. It will be stress free and comfortable working with her.
Response from the owner:Sharon, thank you so much for your thoughtful review—and for reaching out to us all the way from Canada. We know how challenging it can be to navigate a Virginia probate matter from out of the country, and I’m really glad our team was able to make that first step a little easier.

I’ll be sure to share your kind words with Emily. She truly has a gift for listening and guiding clients through what can feel like an overwhelming process, and your feedback means a lot.

We appreciate the opportunity to assist you and look forward to working with you every step of the way.

Steve Bingham was a huge help in assisting my family with selling my mother’s house after her passing. I am out of state and the house needed some work. We used his guidance to sell the house quickly and for more money than expected.
Response from the owner:Jason, thank you—I really appreciate you taking the time to write this.

I know handling everything from out of state, especially with a home that needed a lot of work, isn’t easy. I’m glad I could help guide you through it and get the property sold quickly with a better-than-expected result.

It was a privilege to work with you and your family during a difficult time. If you ever need anything in the future, don’t hesitate to reach out.

My mother passed and ger affairs were in order. However, my siblings and I have little experience with probate and estates.

The staff at the Legacy Elder Law Center were excellent. Responsive, immediate appointment, superb job breaking down the process, which turned out to be easy for us. The main thing was it took time.

Special thanks to Rachael Watkins who stayed on top of things, explained everything thoroughly, and gently but persistently nudged the executor, ME, to get everything done. Thanks so much Legacy Elder Law Center!
Response from the owner:John,
We’re glad our team was able to make the probate process clear and manageable during a difficult time. It’s great to hear that Rachael provided the right balance of guidance and follow-up to help keep everything on track.

We truly appreciate your kind words and your trust in us.

Liz was very knowledgeable about the services provided by Elder Law Center. She was very patient and explain the process in depth.
Excellent session! Emily listened very well and responded with thoughtful questions that helped provide clarity for all.
Where to start! This law firm is FANTASTIC! As a child of elderly parents in the midst of an alarming legal situation dealing with their care, they were the only firm in town that 1. answered the phone and 2. connected me to someone who could help me right away. The person I worked with was Emily Wanchisn, a wonderful person and paralegal. She helped me interpret the legal documents that were signed by my parents, explained what my responsibilities and limitations were, and did it all with a kindness and compassion you don't find very often in the world these days. I was never once made to feel "crazy" which can happen when emotions are high. I hope someone reads this review and it informs their decision to hire this law firm. They are great and know their stuff!
I stumbled on Legacy Elder Law at a critical moment in my mom’s health care journey when I believed I had run out of options. The team at this firm quickly engaged and presented options for helping my mom qualify for Medicaid. Specifically, Odalis took the time to meet with me and explain the process in detail, particularly when I was feeling overwhelmed. She treated me and my family’s situation with kindness, respect and professionalism. Unfortunately, my mom passed before we could complete the process, but Odalis and the LELC team took the time to offer sincere condolences for my loss. I strongly encourage families to seek the services of LELC to properly plan for your loved one’s estate planning and long term care needs prior to critically needing a plan.
